DAABOG Terms of Service
Version 1.0 — effective 6 October 2026
Provider: DAABOG Technologies LLC, a Delaware (USA) limited liability company, formed 6 October 2026 ("DAABOG", "we").
Customer: the business or professional accepting these Terms ("you"). The platform is a business-to-business service for real-estate professionals; by accepting, you represent you are acting in a professional capacity, not as a consumer.
1. The service
DAABOG provides a platform for off-plan real-estate professionals comprising, as available to your account: the off-plan project catalogue and map; a professional social feed and listings; direct messages, channels, and organization broadcasts; Deal Rooms (confidential transaction workspaces, including a client guest seat); white-label agent websites on your own domain; project-briefing share links; an inventory-ingestion service; the DAABOG CRM (where subscribed); and developer/organization workspaces and analytics.
We may improve, add, or retire features. We will give reasonable notice of changes that materially reduce a paid capability.
2. Accounts, organizations, and identity
2.1. Accounts are individual. One person, one account. You are responsible for your credentials and for activity under your account. Credential sharing is prohibited (AUP §2).
2.2. Registration and verification. Registration requires a valid email address; certain capabilities additionally require a verified phone number. Professional verification (the "verified" badge) is optional and is based on review of professional brokerage credentials; it is a review record, not a guarantee (see §8).
2.3. Organizations and employment ties. Agencies and developers exist as organizations. A person is one account; employment is a link ("tie") between an account and an organization — entered bilaterally (organization invites, member approves), and severable unilaterally by either side with immediate effect. Ending a tie ends the organization-derived entitlements it carried; it does not merge, transfer, or divide either party's underlying data or account.
2.4. Roles. Organization capabilities (e.g. developer inventory management, organization broadcasts) are gated to authorized members of that organization. Platform administration is DAABOG's alone.
3. Subscriptions, entitlements, and pricing
3.1. Model. Access is entitlement-based. At a high level: an account or organization carries one or more capability pillars (e.g. projects — developer inventory; listings — brokerage/ agency marketplace activity), and specific product entitlements (e.g. a white-label website, or portal access to the full catalogue detail) which may be time-bounded and may derive from an employment tie or a subscription.
3.2. Free tier principle. Registration is required to use the platform, but viewing inventory, project pages, and the feed is not paywalled. Paid subscriptions attach to professional tools and surfaces (e.g. white-label sites, portal detail beyond the free daily allowance, CRM). Unentitled accounts may be metered (e.g. a daily cap on full project-detail views).
3.3. Billing. Entitlements lapse at their end date if not renewed.
3.4. Trials/pilots: see the refund and cancellation terms at daabog.com/refund.
4. Your content and data
4.1. Yours stays yours. You retain all rights in content you submit (listings, posts, media, documents, messages, inventory data).
4.2. License to us. You grant DAABOG a worldwide, non-exclusive license to host, store, process, reproduce, display, and distribute your content as needed to operate the service as you configure it — e.g. publishing a listing to the feed and/or your white-label site per your publish choices, rendering rooms to their members, generating exports, creating derived technical artifacts (thumbnails, rasterized previews, search indexes). This license ends when the content is deleted from the service, except as retained under the Retention Schedule (backups, evidentiary records).
4.3. Publish channels are explicit. Listing distribution is controlled by explicit per-channel publish flags (feed; white-label site), default-off, set by you or by your linked CRM. DAABOG does not republish your listings to channels you did not enable.
4.4. Catalogue data. The off-plan catalogue (projects, units, pricing, media, geodata, platform-generated descriptions) is DAABOG's database, compiled from developers and partners. You receive a right to use it within the service (including your white-label site and client shares); you may not extract or republish it outside the service (AUP §2).
4.5. Deal Rooms. Room content is immutable for participants, encrypted at rest, and governed by the room terms accepted at entry (including the consent ledger and the 6-year deletion tombstone, both disclosed there). The confidentiality model — including the fact that DAABOG manages the encryption keys and the service is not end-to-end encrypted — is stated in the DPA (daabog.com/dpa) and Privacy Policy; you are responsible for what your organization discloses to whom inside a room.
4.6. Your clients' data. Where your use involves your clients' personal data (Deal Room guests, leads, CRM tenant data), the DPA (daabog.com/dpa) governs; you warrant you have the necessary rights and notices in place to submit that data.
4.7. Feedback you volunteer about the service may be used without restriction or obligation.
5. Acceptable use
The Acceptable Use Policy is part of these Terms. Its enforcement ladder (content suppression, capability locks, suspension, ban, administrative removal) is summarized there and is the operative one.
6. Intellectual property
The platform (software, design, trademarks, the DAABOG name and marks) is DAABOG's. White-label sites intentionally present your brand on your domain; that does not transfer any DAABOG IP to you, and you may not use DAABOG marks except as the service itself renders them. No rights are granted by implication.
7. Third-party services
The service depends on third-party providers (hosting, edge/CDN, email, phone verification, AI processing for inventory ingestion, map tiles, payments, and — when active — WhatsApp), listed with what they receive in the Sub-processor Register (daabog.com/privacy#subprocessors). Your use of the service constitutes the necessary instruction to route data through them as described. Custom-domain white-label sites additionally depend on your own domain registrar/DNS configuration, which is your responsibility.
8. Disclaimers
8.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". DAABOG DISCLAIMS ALL IMPLIED WARRANTIES (MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT) TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8.2. DAABOG is a platform, not a party to real-estate transactions. We are not a broker, agent, or developer; we do not verify title, permits, pricing accuracy, or availability of any listed property; catalogue and listing data may be incomplete or out of date; currency conversions are indicative (daily reference rates and fixed pegs), not transactional. The "verified" badge reflects a document review at a point in time and is not an endorsement, license check subscription, or guarantee of conduct.
8.3. Platform-generated project descriptions are produced with AI assistance from project metadata and are informational; investment-return projections are deliberately excluded and nothing on the platform is investment advice.
8.4. No warranty of uninterrupted or error-free operation; scheduled and emergency maintenance happen.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA (EXCEPT DATA-RESTORATION COSTS PROXIMATELY CAUSED BY DAABOG'S BREACH OF THE DPA); (b) EACH PARTY'S AGGREGATE LIABILITY UNDER THESE TERMS IS CAPPED AT THE FEES PAID OR PAYABLE BY THE CUSTOMER IN THE 12 MONTHS PRECEDING THE EVENT, OR, FOR AN ACCOUNT THAT HAS PAID NO FEES, USD 100; (c) NOTHING LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR AMOUNTS THAT CANNOT BE LIMITED BY LAW.
10. Indemnity
You will defend and indemnify DAABOG against third-party claims arising from your content, your listings, your real-estate dealings with your clients and counterparties, or your breach of these Terms (including the AUP), except to the extent caused by DAABOG's breach.
11. Term, suspension, termination
11.1. These Terms apply from first account use and continue until terminated.
11.2. By you: you may stop using the service at any time and may request account deletion (anonymization) under the Privacy Policy; see the refund and cancellation terms at daabog.com/refund.
11.3. By DAABOG: we may suspend or restrict accounts per the AUP enforcement ladder, and may terminate for material breach uncured within 30 days of notice (or immediately for severe AUP violations, unlawful use, or security risk).
11.4. Effects. On termination, access ends; your data is handled per the Privacy Policy and, for Customer Personal Data, the DPA's return/deletion clause at daabog.com/dpa (including the stated evidentiary and statutory carve-outs: consent ledger, tombstones, audit trail, billing records, backup aging). Deal Rooms you participated in are multi-party: your departure triggers the export offer; it does not delete the room for the remaining participants.
12. Governing law and disputes
12.1. These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
12.2. UAE and other local users. Nothing in these Terms deprives you of mandatory protections of the law of the place where you are established, and data-protection rights under the UAE PDPL (and, for EU-located processing, EU law) apply as described in the Privacy Policy regardless of the governing-law clause. Real-estate regulatory compliance in the jurisdiction where property is marketed remains your responsibility (AUP §3).
13. General
Assignment: DAABOG may assign these Terms to an affiliate or a successor; you may not assign them without DAABOG's prior written consent; entire agreement (these Terms + AUP + Privacy Policy + DPA at daabog.com/dpa + any order form); order of precedence: an order form, then the DPA (for data protection), then these Terms, then the AUP; severability; no waiver; notices to DAABOG Technologies LLC, 8 The Green, Suite A, Dover, Delaware 19901 and to your account email.
DAABOG may change these Terms at any time. Changes that do not materially reduce your rights (wording, legal or security requirements, new features) apply on publication without prior notice. Material changes are announced by email or in-app at least 7 days before they apply. Continued use after a change takes effect means acceptance.
DAABOG Acceptable Use Policy (AUP)
This Acceptable Use Policy is incorporated into the DAABOG Terms of Service. It applies to every user of the DAABOG platform — individual agents, agency and developer organization members, white-label site operators, and Deal Room guests. Capitalized terms are defined in the Terms.
1. The short version
DAABOG is a professional network and inventory platform for real-estate professionals. Don't scrape it, don't post listings that misrepresent property or price, don't spam or harass people, don't probe other tenants' data, and don't use the platform to break the law. We can and will restrict accounts that do.
2. Prohibited: scraping and bulk extraction
You may not, without DAABOG's prior written consent:
- crawl, scrape, harvest, or bulk-download the off-plan project catalogue, listings, pricing, availability data, images, or member directory, whether by automation or systematic manual collection;
- access the platform's APIs other than through the provided interfaces and your own authenticated session, or circumvent rate limits, authentication, or access gates;
- republish, resell, or feed catalogue or listing data into a competing product or dataset;
- use another member's credentials, or share yours, to expand access.
Ordinary professional use — sharing individual projects with your clients via the platform's own share, briefing, white-label, and export features — is what the platform is for and is not restricted by this section.
3. Prohibited: fraudulent or deceptive listings
Identity verification on DAABOG is optional and jurisdiction-agnostic: a "verified" badge means we reviewed professional credentials; the absence of a badge is not an accusation. Fraud is therefore defined by substance, not by badge status. A listing (including feed listings and white-label site listings) violates this policy if it:
- offers property the lister has no right or mandate to offer;
- materially misstates price, availability, unit specifications, location, or completion status;
- advertises a property or project that does not exist, or uses imagery/documents of a different property as if they were of the listed one;
- conceals or misrepresents the lister's identity or organization;
- violates applicable real-estate advertising rules in the jurisdiction where the property is marketed (e.g. permit-number requirements) — the lister, not DAABOG, is responsible for jurisdiction-specific compliance;
- is posted or kept published after the lister knows the material facts have changed.
Investment-return promises: platform-generated catalogue copy deliberately strips return projections (ROI/yield/appreciation claims). Members must not use the feed, listings, messages, or white-label sites to make unsubstantiated return promises to the public.
4. Prohibited: spam and abusive conduct
In the feed, replies, stories, channels, broadcasts, direct messages, and Deal Rooms, you may not:
- send bulk unsolicited messages, or repeated unwanted contact after a recipient has objected or blocked the interaction;
- post repetitive, off-topic, or bait content at a volume that degrades the feed;
- harass, threaten, or defame others, or post hate speech or sexually explicit content — this is a professional platform;
- impersonate any person or organization, including other members and developers;
- misuse broadcast channels (organization channels exist for organization announcements; the ability to send is technically restricted to the organization's authorized senders);
- introduce malware, or upload files intended to exploit the platform or its members;
- use Deal Rooms or invites to phish, defraud, or exfiltrate counterparties' information.
5. Prohibited: platform integrity violations
- probing or attempting to access other organizations' data;
- attempting to bypass tenant isolation, guest-token controls, publish gates, or the consent gate on Deal Rooms;
- load testing, vulnerability scanning, or penetration testing without written authorization;
- interfering with service operation (flooding, deliberate resource exhaustion).
Good-faith security reports are welcome at admin@daabog.com; we will not treat a good-faith, non-disruptive report as a violation of this section.
6. Enforcement — what we actually do
Enforcement uses the platform's real account-lifecycle and visibility machinery:
- Content-level measures. Non-compliant listings and posts can be unpublished or suppressed from public and feed surfaces by platform administrators. Deal Room content is immutable by design and is not edited by DAABOG; Deal Room deletion is controlled by platform administrators (with its 6-year metadata tombstone).
- Capability locks. Certain capabilities (posting listings, sharing, direct messages) are technically gated on account verification state and can be withheld from unverified accounts.
- Suspension. A reversible restriction: login is blocked, existing sessions are revoked immediately, and the account's content is hidden from public and feed surfaces by the platform's visibility rules. Used for violations we expect can be remediated, and normally preceded by a warning unless the violation is severe or ongoing.
- Ban. The same enforcement as suspension, applied as a terminal decision for severe or repeated violations (fraud, abuse, scraping at scale, integrity attacks).
- Administrative removal. The account is deactivated and treated at login like a non-existent account.
- What restriction is not. Restriction retains data (there is no hard delete of accounts). Erasure/anonymization is a separate, distinct process governed by the Privacy Policy — a banned member retains their statutory data-subject rights, and a restriction is neither an erasure nor a bar to requesting one. Conversely, requesting erasure does not undo accountability records (audit trail, consent ledger) retained on a legal-claims basis.
- Organizations. Organization accounts (agencies, developers) can be restricted the same way; restricting an organization suppresses its public identity and content surfaces. White-label sites are entitlement-based and the entitlement can be revoked, which takes the site down.
- Rate limits and technical countermeasures apply automatically and are not "punishment" — tripping them repeatedly is, however, evidence for this policy.
Every administrative enforcement action is recorded in a metadata-only audit trail.
7. Grounds for suspension or termination
DAABOG may restrict an account (suspend, ban, or administratively remove) where it reasonably determines that:
- this AUP or the Terms have been violated;
- the account is being used unlawfully, or a competent authority requires action;
- the account presents a security risk to the platform or its members (including compromised credentials);
- payment for a paid subscription has failed and remains uncured;
- the account was created or is used to evade a prior restriction.
Where practicable for non-severe violations, DAABOG will warn first and give a reasonable cure period. Severe violations (fraud, integrity attacks, unlawful content) may be restricted immediately. Appeals go to admin@daabog.com; reinstatement from suspension restores the account exactly (reactivation restores prior state).
8. Reporting
Report violations via the in-app "Report a problem" feature or to admin@daabog.com. Reports are reviewed by platform administrators.
